1) Buy an email list
Some time ago, many companies built up large email lists and tried again and again to send newsletters without any segmentation, hoping that one of the users would be that " ideal user " and then make a transaction.


This has changed thanks to various regulations and efforts to protect users, but some still do it.

Needless to say, you should avoid being part of those who are in favor of this bad practice, because you could end up with legal actions against you or your company. Be careful !

2) Clickbait
If you are not familiar with the term, " clickbait " is the Anglo-Saxon concept most equivalent to deception, as if it were using bait.

In the context of email marketing or newsletters, when a brand is said to be using “clickbait” it means that it includes biased or false communication in part of the message (especially in the subject line).

A perfect example of the latter is including subjects like “ your shipment is on its way ” when the user clearly has not ordered anything online; the point is that the same subject “ forces ” the user to read the email only to discover that the content has nothing to do with the subject. This can be considered fraudulent communication and/or advertising , and you can be subject to many legal problems… so avoid it, at all costs.

3) Failure to comply with basic CAN-SPAM requirements
There are other details or errors in email marketing that can lead to major complications, especially in European territory.

With this I go from something " simple " like not including contact details in the footer of the newsletter, to not having a link to modify or cancel the subscription.

Requirements like this are actually CAN-SPAM Act laws to protect users from fraudulent and biased email content, so skipping one of these steps can lead to lawsuits, and I know full well you don't want that.
